What is Section 37 of the Children Act 1989?
Section 37 specifically empowers the court to make interim care orders. These are temporary orders that allow a local authority to remove a child from their current living situation and place them in the care of the authority. The court can ask the local authority to step in with private law proceedings between parents. Interim care orders are usually granted when there are urgent concerns about the child’s safety or welfare.
This section provides the court with the authority to issue interim care orders if it believes that the child is suffering significant harm, or is likely to suffer significant harm, if they remain in their current environment. It allows the local authority to take immediate action to protect the child and ensure their well-being while a more thorough assessment of the situation is carried out.
